Rabin Law Firm Proposes NYS Anti-BIKER PROFILING Bill

Syracuse attorney, biker rights advocate and B.A.D. Rep, Ben Rabin is pushing for an “anti-biker profiling” bill in NYS replicating the bill passed in Washington State in 2011. As you may be aware, there has been an increase in the profiling and persecution of motorcyclists in the New York State area. People who ride motorcycles have been the subject of
“motorcycle-only road blocks” as well as alleged “safety inspections” at the hands of law enforcement, but particularly the New York State Police. As I am sure you are aware, if this happened to any other group in New York, the act of profiling would be treated with outrage and action. Here, however, the motorcyclists have been left to fend for themselves.
A lawsuit has been commenced against the New York State Police, and it is winding its waythrough the court system. However, it seems that this matter would be appropriately addressed by the legislature.
Similar difficulties occurred recently in the State of Washington. They were so outraged at the behavior of the law enforcement agencies that they passed a law to prohibit these actions. I am writing to plead with you that you introduce a bill that would do the same thing here: end the harassment, profiling and persecution of people who choose to transport themselves with a motorcycle rather than a car.
I have attached for your review the proposed legislation, as well as the final passed legislation. I would be honored if you would introduce something similar to the proposed legislation and, with the backing of every registered motorcyclist in New York, champion our right to travel down the highway as unmolested as every other registered motor vehicle owner.

B.A.D. Proposes NYS Bills To Fight Biker Discrimination

B.A.D. has crafted two Bill Proposals for amendments in NYS Law which would protect citizens who are members of a culture from discrimination based primarily upon the fact they are in or affiliated with that culture in NYS.  If these bills are sponsored and passed it would create civil rights protections for all those in the American Biker Culture, as well as in other “unconventional cultures” within the State of New York.

The proposed bills have been previously approved by B.A.D. Reps Mike Willig(Warren County), Attorney Ben Rabin, Regional Rep(Vermont/New Jersey) Jamie Slater, B.A.D. Secretary Lisa Petrocelli and Executive Director of B.A.D. Hank McGrath. Each bill will be sent to targeted legislators for sponsorship. The proposed bills are crafted in bill form and the explanations thereof are noted below:

Bill #1 (below) is to amend the NYS Constitution to include equal protections of the law for all citizens in “CULTURE’S” and to include the word “culture” in the amendment. This Bill is directed to both the Senate and Assembly seeking sponsorship support from both.

TITLE OF BILL:
CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
proposing an amendment to section 11 of article 1 of the constitution, in relation to equal protection of laws.

PURPOSE OR GENERAL IDEA OF BILL:
This establishes an Equal Rights Amendment (ERA) to the New York State Constitution to insure that no person in the State of New York will be denied equal protection of the laws based on the culture and/or cultural lifestyle of the person.

SUMMARY OF SPECIFIC PROVISIONS:
Adds the category of “culture” to the protected categories of section 11 of article 1 to the New York State Constitution.

JUSTIFICATION:
Only a constitutional amendment will guarantee that men and women are treated equally under the law. Further, a constitutional amendment will require that the courts of New York use a strict scrutiny standard when reviewing cases of discrimination based upon ones culture. In the 21st century, in New York, it is inconceivable that citizen’s of unconventional cultures within New York State do not have the constitutional protection of being treated equally under the law.

Section 1. RESOLVED (if the Assembly concur), That section 11 of
article 1 of the constitution be amended to read as follows:

S 11. No person shall be denied the equal protection of the laws of
this state or any subdivision thereof. No person shall, because of race, color, sex, creed, religion, OR CULTURE be subjected to any discrimination in his or her civil rights by any other person or by any firm, corporation, or institution, or by the state or any agency or subdivision of the state.

S 2. RESOLVED (if the Assembly concur), That the foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly, and, in conformity with section 1 of article 19 of the constitution, be published for 3 months previous to the time of such election.
EXPLANATION–Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

Bill No #2 is an amendment to the New York State Human Rights Law called Executive Law Article 15 which governs discrimination against citizens in public accommodations, employment, education, housing and so on.  This bill simply seeks an inclusion of the word “CULTURE” into the protection phrase. CONCERNING A PROHIBITION ON DISCRIMINATION BASED UPON CULTURE AND CULTURAL LIFESTYLE INPLACES OF PUBLIC ACCOMMODATION.

                                          Bill Summary

(Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted.) The bill adds “CULUTRE” as grounds on which discrimination in places of public accommodation may not be based.

“CULTURE” means any cultural lifestyle which may be celebrated by the wearing of unconventional attire, private meetings in cultural club or association settings, the practice of cultural rituals and rites based upon cultural beliefs and the exercise of cultural principles and intellectual practices uniquely derived from the historically established essence of  that culture.

 Capital letters indicate new material to be added to existing statute. Dashes through the words indicate deletions from existing statute.

Be it enacted by the General Assembly of the                      State of NEW YORK:

 SECTION 1.  In NEW YORK Executive Law Article 15  

 HUMAN RIGHTS LAW, § 291. amend

 (1) as follows:

 § 291. Equality of opportunity a civil right.

  1.     The opportunity to obtain employment without discrimination because of age, race, creed, color, national origin, sexual orientation, military status, sex, marital status, disability, OR CULTURE is hereby recognized as and declared to be a civil right.

 Amend (2) as follows:

 2.     The opportunity to obtain education, the use of places of public accommodation and the ownership, use and occupancy of housing accommodations and commercial space without discrimination because of age, race, creed, color, national origin, sexual orientation, military status, sex, marital status, disability, OR CULTURE as specified insection two hundred ninety six of this article, is hereby recognized as and declared to be a civil right.

 § 295.  Part 8 & 9amend

(3) as follows:

General powers and duties of division – Part 8 & 9

 8. To create such advisory councils, local, regional or state wide, as in its judgment will aid in effectuating the purposes of this article and of section eleven of article one of the constitution of this state, and the division may empower them to study the problems of discrimination inall or specific fields of human relationships or in specific instances of discrimination because of age, race, creed, color, national origin, sexual orientation, military status, sex, disability, marital status OR CULTURE and make recommendations to the division for the development of policies and procedures in general and in specific instances. The advisory councils also shall disseminate information about the division’s activities to organizations and individuals in their localities. Such advisory councils shall be composed of representative citizens, serving without pay, but with reimbursement for actual and necessary traveling expenses; and the division may make provision for technical and clerical assistance to such councils and for the expenses of such assistance.

 9. To develop human rights plans and policies for the state and assist in their execution and to make investigations and studies appropriate to effectuate this article and to issue such publications and such results of investigations and research as in its judgment will tend to inform persons of the rights assured and remedies provided under this article, to promote good will and minimize or eliminate discrimination because of age, race, creed, color, national origin, sexual orientation, military status, sex, disability, marital status OR CULTURE.

Amend all parts therein relating to the protection phrase:                    ”without discrimination because of age, race, creed, color, national origin, sexual orientation, military status, sex, marital status, disability, OR CULTURE ” within Human Rights Law to reflect the inclusion of “CULTURE”

This matter is to be referred to Committee for revisions of New York State Human Rights Law - NEW YORK Executive Law Article 15 and Governor is requested to hold public committee hearings on the issue of discrimination based upon ones culture prior to Bill passage.

B.A.D. Seeks US Senator’s Support

Bikers Against Discrimination has recently requested the support of both New York Senators – Kirsten Gillibrand & Charles Shumer on the proposed federal highway appropriations measure (S.1813, ”Moving Ahead for Progress in the 21st Century” or MAP-21) which passed the US Senate by a vote of 74-22 on March 14th, 2012. The measure bars federal funds from being used to conduct motorcycle-only checkpoints and offers $109 billion in funding for safety.

According to recent news on the measure provided by Bill Bish of NCOM BIKER NEWSBYTES: “The measure now goes to the House of Representatives for further action, where a similar measure is also being considered (H.R. 7, the “American Energy and Infrastructure Jobs Act of 2012”).Both bills contain motorcycle safety program funding and both would prohibit motorcycle-exclusive roadblocks, and neither version has any anti-motorcycle provisions, but it’s unclear if the House will take up the Senate bill or advance their own legislation.”

As Executive Director of Bikers Against Discrimination I encourage your support for S.1813, “Moving Ahead for Progress in the 21st Century” or MAP-21 governing the federal highway appropriations primarily because the aforementioned measure would prohibit motorcycle-exclusive roadblocks which at present are used to harass American citizens who are within the American Biker Culture under the guise of “safety check points” by various State agencies. I can attest to the fact thousands of motorcyclists who are members of the American Biker Culture suffer unjust profiling, bias, discrimination and violations to their human/civil/constitutional rights simply because of their cultural lifestyle…much of which stems from malicious propaganda. It is also unconstitutionally used to usurp the necessity for probable cause…

clubs vs CLUBS – Part One

One of the most interesting aspects of fighting for “biker rights” is that which derives from the discrimination against 1%ER’S by outside ridgeriders, as I call them. From the anthropological view, the 1%ER’S are the keyholders to the American Biker Culture and its history in America. Most other motorcycle clubs are on the fringe of that culture….They fear the responsibility which derives from a real CLUB and brotherhood and they fear being discriminated against by the public and the government – so, they play it safe on the outskirts of the heart and soul of the culture…the 1%ER….by acting friendly towards keykeepers (while making attempts to avoid them) and are quick to deny they are associated with or support the keykeepers of the American Biker Culture in the public…rather than aid to dispel the negative propaganda by giving support and REAL friendship to 1%ER’S.

MA. Reps Receive Presidents Award

Geno Gentile and Pete Bickovich, lifelong bikers and biker rights advocates of Massachusetts received the President’s Volunteer Service Award from the President of the United States this weekend (March 24th/25th, 2012) which was presented by Hank McGrath, Executive Director of B.A.D. {Bikers Against Discrimination} and FreedomAction League in New York State and host of Spirit of Biker Radio.

The prestigious award was issued LIVE on the local television show, “The Human Factor”, hosted by Geno Gentile with Pete Bickovich as co-host. Pete was appointed B.A.D. Regional Rep by Hank McGrath.

McGrath, a popular & unique civil rights advocate for the American Biker Culture, made history in 2008/2009 issuing the first President’s Award to 1%ER motorcycle clubs, Hells Angels Nomads New York and the 69′ERS MC NCC, compelling the country to recognize the immense volunteer work motorcycle clubs do to help those who need in communities across America.

New York Rider, B.A.D. & Biker Rights Representatives Demand State Agency Investigation

Carmella Brown of New York Rider Magazine, Attorney & Biker Rights Advocate Ben Rabin, B.A.D. Exec. Director Hank McGrath and “Trucker” – A NY Club Pres. – met with Senator Patty Ritchie at the NYS Legislative Office Building on Wednesday, March 21,2012 to discuss the deathly serious situation all bikers face on the roads and highways of New York State which directly derive from the State’s lack of proper education of drivers, discrimination by both public motorists and law enforcement agencies and the unjust profiling of bikers by State and local law enforcement agencies as a way to harass bikers – under the guise of “safety check points”.

Carmella Brown, who initiated the meeting with the State Senator, pointed out the two serious motorcycle crashes that occurred in West Monroe, New York, on March 18 and 19, 2012 as reason for urgency in this matter and demanded immediate attention of the legislator  by initiating the unused VH Boards on the highways to release warning messages to drivers for the safety of motorcyclists and to investigate the facade created by NY State Police and other agencies regarding “safety check points” as a way to garner funds rather than actually initiate safety campaigns which need to be DIRECTED TOWARDS THE ATTENTION OF CAGED DRIVERS!

Attorney Ben Rabin, who is also an Abate representative in Western New York , stressed the need for available funding for proper public campaigns for motorcycle safety without the biased motorcycle safety check points and laid out a number of facts for the State Legislator regarding how the authorities USE the check points primarily to raise funds to support their projects and livelihood rather than for the actual safety of the biker(s) who have a right to be on the roads and highways like any other citizen. He further requested the State Legislator to review and support proposed bills and resolutions which favor the rights of bikers and motorcyclists in New York State and to investigate how the funding collected from motorcyclists through DMV is actually spent in creating REAL safety for the motorcyclist.

“Trucker” testified to the State Legislator about the law enforcement’s game using tickets as a form of harassment and how many of these tickets are so unreal, yet, difficult to fight – forcing the biker to simply pay rather than spend twice as much to beat the ticket – It is all set up that way…agencies make millions unjustly by abusing the motorcyclists and seemingly punishing them for choosing to ride a motorcycle!

Hank McGrath of B.A.D. explained how law enforcement agencies use profiling, bias and discrimination in their training manuals against those in the American Biker Culture and harm is befalling the bikers because malicious propaganda has become wedged in the citizens mind that, in turn, creates a no-care attitude about bikers by public motorists – putting the motorcyclist in greater danger on the roads and highways! He insisted the State Legislator MUST obtain a copy of all police agency training manuals to review the policy by which they teach others to discriminate against bikers and perpetuate the process.

Senator Patty Ritchie, (R), is from the district of NY in which the recent motorcyclist deaths and injuries have occurred in NYS – from caged drivers changing lanes suddenly…She vowed to look into the issues presented to her by us immediately…and probably has sincere and good intent….Of course, the only thing she could relate to the plight of bikers in NYS was “I have heard the same thing from snow mobile’rs, so I wouldn’t say it’s is entirely a discriminatory matter against motorcyclists…”  IMAGINE? Bikers got passed over again for snow mobile folks! Fact of the matter is – The culture NEEDS TO BE defended along with the common complaints suffered by bikers and motorcyclist. That’s right, Hammerin Hank figured this out several years ago – YOU FIGHT TO ESTABLISH THE BIKER CULTURE and you will retain rights. You fight over just being hanged – well, hangin will be changed to apply only to a few of you and still you will not be able to go in public places, be denied opportunities and harassed by government agencies…SEE WHAT I MEAN YET? Politicians HAVE NO IDEA and therefore NEED representatives who can speak of the Biker Culture just like they would need (and do obtain) representation for any other culture in the State when an issue arises – to better understand those issues…one must know the culture in  which that issue affects the most.

Now, we must remember – a politicians sincere and good intent can last for a moment and reside as a memory thereafter… COLLATERAL DAMAGE HAS BEEN THE NORM in the influence of change and resolutions to any laws in NYS. Rape laws, pedophile laws, child abduction laws – such things required hundreds to thousands of victims before change would ensue!  That is not to say if hundreds of bikers died on NYS highways laws to protect them would suddenly pass. Quite the contrary! It is by this writers experience and wisdom that he can easily say – NOBODY GIVES A FLYING FUCK! And few would disagree…Agencies would first BLAME BIKERS FOR THEIR OWN DEMISE ON THE ROAD and initiate policies that reflect that blame rather than actually FIX THE FUCKIN PROBLEM!

Ya see, to change the laws that affect the freedom and liberty for bikers and motorcyclists you NEED bikers and motorcyclists – ALIVE AND WELL – fighting the system by bogarting a place in every level of politics! If ya cant get in, encourage someone else to! Make a friend of those in office who ride motorcycles. Follow the battle plans of the civil rights era…Example – once African Americans “GOT IN” things began to change, they got positions to propose laws and resolutions,etc… Its a battle plan. Theory is – IF YA DONT FIGHT FOR YOUR RIGHTS YA DONT GET ‘EM! FREEDOM ISNT FREE! Dont let that “I’M an American” crap get to your head when the country essentially is about mixing the pot and losing the historical and cultural strains of its citizens with a BRAND NEW AMERICA you never heard of!  Just think…if you were a State Legislator – wouldnt you agree with the plight of your constituency and have good intent…for the moment? And then when ya look into it some big wigs from different departments/commissions/offices begin warning you and stone walling your efforts and then black mailing you to leave things alone…Hell, ya agree and figure quietly that maybe you will succeed later on at a better time…Lets be real! Thats the nature of the political scheme of things…

But, what we should want from these little government meetings is to garner connections, obtain information that strengthens the fight for rights and to later on – WIN! So, today seeds were planted in the State Senators mind and the minds of her aides. Our further and strategically arranged communications with her office could garner information useful in future battles… We need to work on that.

Last but not least is how we approach the political arena – NEVER approach it as if you want the change NOW! That is unrealistic, shows you are tired and incapable of leading in the issue – Instead, approach the battle with the attitude that even if you secure rights and change in the laws you are going to fucking fight anyways because the CULTURE OF THE AMERICAN BIKER MUST BE SANCTIONED AND ACCEPTED BY EVERY SEGMENT OF SOCIETY – THAT’S RIGHT FOLKS – “TOLERANCE” DOESNT ONLY APPLY TO RACE, AGE, DISABILITY OR RELIGION! It must be applied to cultures in America! Cut the fuckin shit!
